Exclusive practice of acts dedicated to nurses holding a state diploma in operating theatre nursing (IBODE) and the transitional arrangement relating to state-qualified nurses (IDE)
2024 and 2025 have reshuffled the cards for the exclusive exercise of acts reserved for for IBODEs :
- Decree no. 2024-954 of October 23rd, 2024 introduced a new transitional arrangement, representing an expansion of the pre-existing 2019 arrangement, by opening up access to IDEs, of all acts and activities initially reserved for IBODEs.
- This transitional regime and its relevance is being challenged by the Collectif interblocs before the France’s highest administrative court (@Conseil d’Etat), which despite the rejection of a request for suspension in summary proceedings on January 13th, 2025, will nevertheless rule at a later date, on the request to annul decree no. 2024-954.
