Our areas of expertise

Leases

With respect to leases, we can assist our clients at any of the following stages:

Drafting and negotiation of civil, commercial and professional leases
Renewal, termination or assignment of commercial leases
Drafting and negotiation of management and marketing contracts
Representation in rental disputes before the courts and in arbitration proceedings.

Real estate investments

We advise on the acquisition or sale of real estate assets, in particular for healthcare practitioners, operators or groups, but also for foreign individuals seeking to invest in France, on the following issues:

Legal structuring of operations: creation of the appropriate structure to set up
Due diligence
Drafting of contractual documentation for operations
Support and interface throughout the acquisition process with the notary, including preliminary analysis of notarized promises and contracts of sale
Drafting of shareholders’ agreements and partnership agreements
Management of litigation relating to warranties of liability and other specific clauses negotiated as part of the transaction.

Construction

We provide our clients with advisory and litigation support in the context of assistance with project management (“assistance à maîtrise d’ouvrage”) for construction or rehabilitation operations, from the signature of the contract to completion of the operation and its proper execution, covering the following issues:

Legal and contractual structuring of builders
Drafting and negotiation of contracts, including reservation contracts and off-plan lease agreements (“baux en l’état futur d’achèvement”)
Contract management
Claims handling
Amicable or contentious settlement of disputes

Property & co-ownership

We support numerous property managers and owners in managing disputes relating to co-ownership law, including the following issues:

Preventive/precautionary injunctions
Carrying out or challenging works
Judicial appraisals
Recovery or challenge of co-ownership / condominium fees (“charges de copropriété”)
Implementing or challenging decisions adopted during general meetings of co-owners.
