Lerins, with Bruno Lorit, partner in Health, has obtained from the Conseil d’État that the activity of laser refractive surgery is not subject to authorization from the French Regional Health Agency.
In a highly anticipated December 29th 2023 judgment, the Conseil d’État thus overturns the position of the Administrative Court of Appeal of Lyon, which considered that refractive surgery must be subjected to authorization.
Had the Court of Appeal’s decision been confirmed, it would have forced all refractive surgery centers in France to request the issuance of an ambulatory surgery authorization.
