New: Pre-contractual negotiations are now regulated by law. A duty of information and an obligation of confidentiality are placed upon the parties in the negotiations.
The order of 10 February 2016 reforming contract law introduces into the French Civil Code provisions specific to the negotiations that are held during the period preceding the conclusion of a contract (French Civil Code article 1112 to 1112-2). These new provisions will apply to all contracts concluded from 1 October 2016.
