Ordinance no. 2023-77 of February 8, 2023, announced as clarifying and simplifying the rules governing the operation of sociétés d’exercice libéral (SEL), is a perfect example of a reform producing the opposite effect to that intended.

Taken without the much-needed implementing decrees, this ordinance is a source of juridical insecurity for players in the sector, hindering the development of medical structures and making any form of long-term planning difficult.

“It is essential to put in place clear and consistent implementing decrees that will dispel the uncertainties of healthcare professionals and their investor associates. At a time when the financing needs of the healthcare sector and the reduction in public spending are major, no one can be happy with a situation of legal uncertainty in the regulations.”
